Terms of Service

Guessers ("Guessers", "we", "us") is a social prediction game. Groups create private events, make predictions, and record promises between paired players as tickets. These Terms of Service (the "Terms") govern your access to and use of the Guessers website, progressive web app, and related services (together, the "Service").

By creating an account, accepting an invitation, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

• You must be at least 18 years old to use the Service. The Service is not directed at, and may not be used by, anyone under 18.
• Guessers is currently invite-only. Access may require an invitation from an existing member or approval from our waitlist.
• You are responsible for your account: keep your sign-in credentials (password, passkeys, email access) secure, and give us accurate information. You may not share, sell, or transfer your account.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe compromise the integrity or security of the Service.

Historical tokens are virtual entertainment credits with no monetary value. New gameplay uses tickets; token grants are retired. Historical tokens exist only inside the Service. Specifically:

• Tokens cannot be purchased, sold, transferred, exchanged, or redeemed for cash, goods, services, or anything of value, inside or outside the Service.
• Tokens were earned only through play — starter grants and winning predictions. Those historical winnings do not create a right to any payout.
• Guessers does not hold user cash balances and does not process payouts of any kind.
• Historical token and ticket credits are licensed, not owned: we grant you a limited, revocable, non-transferable license to use them within the Service. Balances have no property value and may be adjusted or voided in cases of error, abuse, or account closure.

• New tickets record one agreed item between two opposing players. Creating an event, posting a question, and choosing a side do not require a purchase. Waiting calls that do not pair owe nothing. After the result is final, the paired loser owes the winner the agreed item. Delivery is reported by the losing player and receipt confirmed by the recipient.
• Historical ticket-credit payments were processed by Stripe on Stripe-hosted checkout pages. Guessers never receives or stores your card number. Stripe's own terms and privacy policy apply to the payment itself.
• Historical ticket-credit purchases remain subject to their original terms, including a refund required by applicable law or initiated by us (for example, to correct an error). If a purchase is refunded or charged back, the associated ticket credits are reversed.

Guessers is a game, not a gambling product, wagering service, or prediction market. You agree not to use the Service:

• for real-money gambling of any kind, including using tokens, tickets, events, or predictions to run, settle, disguise, or keep score for cash bets or anything else of monetary value;
• to buy, sell, or trade accounts, tokens, tickets, or event access for money or anything of value;
• in violation of any applicable law or regulation, or where use of the Service would be unlawful;
• to harass, defraud, or impersonate others, or to post content that is unlawful, hateful, or infringing;
• to interfere with the Service — including scraping, probing or circumventing security or rate limits, automating access, or manipulating outcomes, balances, or settlement.

• Events and predictions are created and run by users. The event host settles predictions and their resolution is final within the game; Guessers does not adjudicate outcomes or guarantee that any host resolves fairly or at all.
• If a host becomes inactive, a result may remain pending. Cancelling a paired prediction releases its tickets, so nobody owes anything. Older predictions retain their original refund rules.
• Guessers does not take a share of any pool. Any arrangement members of a group make among themselves outside the Service is their own responsibility and must not involve real-money wagering facilitated through the Service.

You keep ownership of content you submit (event names, predictions, usernames, avatars, notes). You grant us a worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate the Service — for example, showing your username and predictions to other members of events you join.

The Service is under active development. We may add, change, or remove features (including token and ticket mechanics), and we may suspend or discontinue the Service in whole or in part. Balances of historical tokens and ticket credits are play balances only and carry no right to compensation if the Service changes or ends.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or error-free operation, to the maximum extent permitted by law.

To the maximum extent permitted by law, Guessers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. To the same extent, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim arose and (b) fifty US dollars (US$50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

These Terms are governed by the laws of the jurisdiction in which the operator of Guessers is established, without regard to its conflict-of-laws rules, and courts located in that jurisdiction have exclusive jurisdiction over disputes arising from these Terms or the Service, except where the law of your country of residence grants you mandatory protections or venue rights that cannot be waived.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
